Detriot Judge Declares Wiretapping To Be Unconstitutional And Orders A Halt

Judge nixes warrantless surveillance

U.S. District Judge Anna Diggs Taylor in Detroit became the first judge to strike down the National Security Agency's program, which she says violates the rights to free speech and privacy as well as the separation of powers enshrined in the Constitution.

"Plaintiffs have prevailed, and the public interest is clear, in this matter. It is the upholding of our Constitution," Taylor wrote in her 43-page opinion.


Now while the optimistic part of me would like to declare a victory for the Constitution and American rights, the cynical part knows that the NSA program will continue because Bush has made it clear several times before that he can override the Constitution. You remember that historical document that is important to this country's backbone which has checks in place to make sure that even our own government doesn't become tyrannical because we had just broken off from a tyrant English king. That document that our own "King George" repeatedly wipes his ass with.

So I'll let the realist in me settle this: it's a nice beginning, but we'll have to wait and see what effect this has, if any, on a national, ongoing level.
